This article discusses to what extent the widely accepted hypotheses of Hugo Grotius’s crucial impact on the theory of contract law – also in Scandinavia – may be maintained or even positively confirmed. Although few direct references to the works of Grotius can be found in Scandinavian legal literature of the seventeenth and eighteenth century, it would be premature to draw a negative conclusion. An impact of Grotius’s thoughts may rather be demonstrated by thoroughly analysing patterns of argumentation concerning specific (...) contractual topics both in legal literature and case law. The article provides the reader with necessary information on the institutional and intellectual preconditions for the reception of Grotius in the Scandinavian legal orders before discussing the impact of the ‘will-theory’ on the requirements of a legally binding contractual agreement in the works of selected influential legal scholars and in case law in more detail. The analysis confirms that Grotius’s work contributed substantially to shaping the intellectual framework in which the first contract law doctrines in Scandinavia evolved. (shrink)

This paper deals with Frege’s early critique of formalism in the philosophy of mathematics. Frege opposes meaningful arithmetic, according to which arithmetical formulas express a sense and arithmetical rules are grounded in the reference of the signs, to formal arithmetic, exemplified in particular by J. Thomae, whose “formal standpoint”, according to Frege, is that arithmetic should be understood as a manipulation of meaningless figures. However, Frege’s discussion of Thomae’s analogy between arithmetic and chess shows that Frege does not understand his (...) main point, which is that we must distinguish conceptually between statements about chess figures, and the chess pieces they represent. Indeed, Thomae’s fruitful use of this comparison undermines the ontological conception of arithmetic represented by Frege. The chess pieces do not go proxy for anything, but playing chess is not for that reason just manipulation of physical chess figures. This is also Wittgenstein’s point when he criticizes Frege for not seeing the “justified side of formalism”. Thomae’s formalism can be clarified by using the distinction between sign and symbol. Symbols are never meaningless or empty forms or signs, since they have a role or function in a symbolism, which one may call their meaning. The discussion of the chess analogy shows that Frege fails to see this operative aspect of the symbolism. We can conclude that the “formal standpoint” that Frege criticizes is his fabrication, rather than anything we can attribute to Thomae. (shrink)

The main topic of this essay is symbolic mathematics or the method of symbolic construction, which I trace to the end of the sixteenth century when Franciscus Vieta invented the algebraic symbolism and started to use the word ‘symbolic’ in the relevant, non-ontological sense. This approach has played an important role for many of the great inventions in modern mathematics such as the introduction of the decimal place-value system of numeration, Descartes’ analytic geometry, and Leibniz’s infinitesimal calculus. It was also (...) central for the rigorization movement in mathematics in the late nineteenth century, as well as for the mathematics of modern physics in the 20th century.However, the nature of symbolic mathematics has been concealed and confused due to the strong influence of the heritage from the Euclidean and Aristotelian traditions. This essay sheds some light on what has been concealed by approaching some of the crucial issues from a historical perspective. Furthermore, I argue that the conception of modern mathematics as symbolic mathematics was essential to Wittgenstein’s approach to the foundations and nature of mathematics. This connection between Wittgenstein’s thought and symbolic mathematics provides the resources for countering the still prevalent view that he defended an uttrely idiosyncratic conception, disconnected from the progress of serious science. Instead, his project can be seen as clarifying ideas that have been crucial to the development of mathematics since early modernity. (shrink)

Deceased organ donation is widely considered as a case of easy rescue―that is, a case in which A may bestow considerable benefits on B while incurring negligent costs herself. Yet, the policy implications of this observation remain unclear. Drawing on Christopher H. Wellman’s samaritan account of political obligations, the paper develops a case for a so-called opt-out system, i.e., a scheme in which people are defaulted into being donors. This article develops a critical investigation of the epistemological core of Hilbert's foundational project, the so-called the finitary attitude. The investigation proceeds by distinguishing different senses of 'number' and 'finitude' that have been used in the philosophical arguments. The usual notion of modern pure mathematics, i.e. the sense of number which is implicit in the notion of an arbitrary finite sequence and iteration is one sense of number and finitude. Another sense, of older origin, is connected with practices of counting (...) concrete things, and a third sense is linked up with the immediate intuitive experience of multitudes of concrete things. Hilbert's fìnitism is examined with respect to these differences, and it will be shown that there is a tendency to conflate the different senses of number and fìnitude, a tendency which has been a source of problems in the discussion of the foundations of mathematics and in the philosophy of logic and language. It now seems technically feasible to culture human embryos beyond the “fourteen‐day limit,” which has the potential to increase scientific understanding of human development and perhaps improve infertility treatments. The fourteen‐day limit was adopted as a compromise but subsequently has been considered an ethical line. Does it remain relevant in light of technological advances permitting embryo maturation beyond it? Should it be changed and, if so, how and why? What justifications would be necessary to expand the limit, particularly given that (...) doing so would violate some people's moral commitments regarding human embryos? Robust stakeholder engagement preceded adoption of the fourteen‐day limit and should arguably be part of efforts to reassess it. Such engagement could also consider the need for enhanced oversight of human embryo research. In the meantime, developing and implementing reliable oversight systems should help foster high‐quality research and public confidence in it. (shrink)

Zusammenfassung: Fehlinterpretierte Dokumente und ignorierte physikalische Fakten: Die Geschichte von,Hitlers Atombombe‘ muss korrigiert werden. Warum haben die deutschen Physiker während des Zweiten Weltkriegs keine Atombombe entwickelt? Seit mehr als 25 Jahren sind sich die Historiker einig, dass die deutschen Physiker wussten, wie eine Atombombe gebaut werden muss, dass aber ein Programm wie das amerikanische Manhattan‐Projekt zu ihrer Realisierung in Deutschland, erst recht während des Krieges, unmöglich war. Eine genaue Analyse aller erhaltenen Original‐Dokumente über die Arbeit an der Atombombe während des,Dritten (...) Reichs‘ zeigt jedoch erhebliche Fehler der Autoren durch unvollständige Analyse der Dokumente, falsches Verständnis naturwissenschaftlicher Erläuterungen und Ignorieren physikalischer Fakten. Es wird nachgewiesen, dass die deutschen Physiker bis zum Ende des Krieges nicht bemerkt hatten, dass eine Atombombe nur mit schnellen Neutronen realisiert werden kann. Nur Heisenberg hatte das richtige Prinzip spät erkannt, es aber nicht eindeutig kommuniziert und auch in keiner Weise physikalisch vertieft. Die physikalisch korrekte Interpretation der Dokumente zeigt, dass die deutschen Physiker während des Krieges erfolglos versuchten, einen Reaktor zu entwickeln, der auch eine Voraussetzung für den Bau einer Plutonium‐Bombe gewesen wäre. Aber sie wussten nicht, wie eine Bombe realisiert werden kann, weil sie nie an einer realistischen Theorie der Atombombe gearbeitet hatten. Summary: Misinterpreted Documents and Ignored Physical Facts: The History of ‘Hitler's Atomic Bomb’ needs to be corrected. Why have the German physicists not developed an atomic bomb during World War II? For more than 25 years, the historians agree that they knew how to build the bomb, but that a bomb‐development programme of the size of the US‐Manhattan‐Project would not have been possible in wartime Germany. A detailed analysis of all preserved documents on the German atomic bomb research during the ‘Third Reich’, however, reveals considerable mistakes by the authors due to incomplete analysis of documents, misinterpretations of scientific explanations and ignoring of physical facts. It is shown that until the end of the war the German physicists did not know that an atomic bomb can only be made with fast neutrons, except Heisenberg, who, however, discovered it rather late, did not communicate it clearly and did not study any bomb physics. The physically correct interpretation of the documents reveals that the German physicists worked unsuccessfully on a reactor, which would have been a prerequisite for a plutonium bomb. But they did not know how to build a bomb because they never worked on a realistic bomb theory. (shrink)

Philosophy and science employ abstract hypothetical scenarios- thought experiments - to illustrate, defend, and dispute theoretical claims. Since thought experiments furnish no new empirical observations, the method prompts two epistemological questions: whether anything may be learnt from the merely hypothetical, and, if so, how. Various sceptical arguments against the use of thought experiments in philosophy are discussed and criticized. The thesis that thought experiments in science provide a priori knowledge through non-sensory grasping of abstract entities is discussed and rejected. The (...) thesis that thought experimentation consists in manipulations of mental models is examined and found to be of limited epistemological relevance. It is argued that thought experiments are associated with characteristic arguments in a manner similar to ordinary experiments. It is further argued that thought experiments function in the same way as experiments in general: by providing premises for their associated arguments. Like other experiments, a thought experiment is successful when the premises it provides are true. This holds both for philosophical and scientific thought experiments. An argument schema is proposed and shown to be a formal analogue to that associated with ordinary experiments; similar in being subject to epistemological holism; but differing in being modal: in employing statements about possibility and necessity. The evaluation of thought experiments thus depends on how modal statements may be justified. Intuition and conceivability are discussed as sources of modal justification and found problematic. Instead it is suggested that evaluation proceed by accommodation of the statements describing the experiment's hypothetical scenario. The method of accommodation is developed and applied to five influential thought experiments in philosophy: the brain in a vat; Putnam's Twin Earth; Burge's arthritis example; Searle's Chinese Room; and Newcomb's problem. Its application shows some of these to be failed, others to be successful only relative to controversial philosophical doctrines. (shrink)

Two ways of characterizing natural kinds are currently popular: the Kripke-Putnam appeal to microstructure and Boyd’s appeal to causal homeostasis. I argue that these conceptions are more divergent than is often acknowledged, that they give no credence to essentialism, and that they are both faulty. In their place, I sketch an alternative view of natural kinds, which I call “bare projectibilism”. This conception avoids the appeal to explanation common to microstructuralism and the causal homeostasis view, but is still compatible with (...) scientific realism. (shrink)

It is widely held that the meaning of certain types of terms, such as natural kind terms, is individuated externalistically, in terms of the individual's external environment. Recently a more radical thesis has emerged, a thesis we dub 'a posteriori semantics.' The suggestion is that not only does a term's meaning depend on the external environment, but so does its semantics. One motivation for this is the aim to account for cases where a putative natural kind term fails to pick (...) out a natural kind: The term may have a standard externalist semantics (if it picks out a natural kind) or a more descriptivist one (if it does not). Knowing which semantics applies will therefore require detailed empirical knowledge. This move has also been employed in cases where a singular term, such as a name, fails to have a reference. We argue that a posteriori semantics is inherently implausible, since the type of semantics common terms should be given ought not to be conditional on details of chemistry or physics. A number of difficulties for the position—'metaphysical,' epistemological, and methodological—are articulated. Finally, we suggest that a posteriori semantics misconstrues the way in which semantics is empirical. (shrink)

In this article I argue for the continuity of Sartre's theory of alienation. Therefore, I will depict how the concept of 'alienation' is further developed by Sartre since his early writings, by discussing the different forms of alienation in his late oeuvre and in his works on moral philosophy. First, I will take up the differenciation of individual and social alienation and, furthermore, I will discuss Sartre's radicalized form of alienation, which is beyond pure forms of exploitation or recurrence and (...) was not discussed in the literature, yet. I will connect Sartres theory of value in his "L'Être et le Néant" with the theory of alienation in his "Cahiers pour une Moral" and the "Critique de la Raison dialectique". (shrink)

This paper deals with Wittgenstein's statement that our "craving for generality" is a main source of confusion in philosophy. It is argued that difficulties connected with this tendency also affect most attempts to explain or elaborate Wittgenstein's philosophical thinking, since most commentaries elucidate his thinking in general terms, in the notions and classificatory apparatus of some prevalent vocabulary of professional philosophy. It is argued that this craving for generality is closely tied up with another tendency of traditional philosophy, namely the (...) tendency to impose substantive normative claims. The effort to dissociate himself from this tendency is a main feature of the late Wittgenstein's philosophy that has not been sufficiently observed. /// O presente ensaio trata da afirmação de Wittgenstein segundo a qual "a nossa ânsia de generalidade" constitui umafonte principal de confusão em filosofia. These two complementary works give the reader a unique insight into the breadth and substance of Kierkegaard's thought. One reads like a novel and the other a Platonic dialogue but both concern the nature of love, faith, and happiness. These are the first translations to convey the literary quality and philosophical precision of the originals.

This contribution examines Miscevic’s defence against restrictionist X-phi, based on his view that thought experiments exhibit a large number of typical stages. On Miscevic’s view, the epistemic threats identified by proponents of the negative program in X-phi may be countered or ameliorated in various ways at various stages. I argue that the defence he offers is insufficient to counter the arguments by in particular Machery.

Recent debates about thought experiments have focused on a perceived epistemological problem: how do thought experiments manage to provide knowledge when they yield no new empirical data? A bold answer to this question is provided by James Robert Brown’s platonisrn, according to which a certain class of thought experiments allow a sort of intellectual perception of laws of nature, understood as relations between universals. I suggest that there are three main problems with platonism. First, it is restricted to a very (...) small class of thought experiments; hence, it largely fails to address the general epistemological problem. Second, it is not quite clear what it is supposed to explain. Third, its explanatory value in any case seems dubious, since the mechanisms it postulates (i) appear to raise issues more ditficult than what they would explain, and (ii) seem to obviate the very need for conducting thought experiments. I also argue that it fails to give an accurate account of Brown’s flagship example, Galileo’s thought experiment on falling bodies. In conclusion, I suggest that although platonism about thought experiments is an exciting thesis, it is at present unconvincing. (shrink)

Michael Della Rocca has recently argued that Kripkean essentialism is subtly self-defeating: to defend it, certain modal intuitions must be reconstrued in terms of similarity, but reconstruing them in this way threatens the principled rejection of similarity comparisons on which Kripke's essentialism depends. Della Rocca holds that Kripke's strategy must assume the necessity of identity, and that the necessity of identity already presupposes essentialism, which renders the defence circular. Against this, I argue that the necessity of identity may be accepted (...) independently; therefore no circularity need arise. I also argue that Della Rocca fails to rebut an objection raised by Stephen Yablo. (shrink)

This special double issue of _Cybernetics and Human Knowing_ is comprised of a collection of papers devoted to the cybernetics and mathematics of Charles Sanders Peirce with a special focus on its synergies with George Spencer-Brown's thinking. Peirce was a truly original American philosopher and logician working in the late 1800s and early 1900s; Spencer-Brown is an English polymath, best known as the author of _Laws of Form_. The contributions reflect the extraordinary richness of Peirce's work and his relevance to (...) present concerns in cybernetics. This book brings together international experts on the application of Niklas Luhmann’s theory of society as autopoietic communication. Luhmann’s sociological systems theory is counter-intuitive and in its detached coolness difficult for many to understand and accept. Naturally they ask: is it really worth the trouble to learn? This book demonstrates what this combination of systems theory, Batesonian information theory, von Foerster’s second-order cybernetics, Maturana and Varela’s autopoiesis and Husserl’s phenomenology can offer. In The Philosophy of Philosophy, Tim Williamson has offered a sophisticated account of thought experiments and of modal epistemology. More recently, he has also engaged in a variant of the so-called ‘expertise defence’ of traditional philosophical methodology. In this paper I argue that if Williamson’s account of thought experiments and of modal epistemology is right, this seriously undermines his version of the expertise defence.

In a recent article in the Journal of Medical Ethics, Neil Manson sets out to show that the meta-consent model of informed consent is not the solution to perennial debate on the ethics of biobank participation. In this response, we shall argue that Manson’s considerations on the costs of a meta-consent model are incomplete and therefore misleading; his view that a model of broad consent passes a threshold of moral acceptability rests on an analogy that misconstrues how biobank research is (...) actually conducted and a model of meta-consent is more in tune with the nature of biobank research and enables autonomous choice. The emerging epistemic community of ecosemioticians and the multidisciplinary field of inquiry known as ecosemiotics offer a radical and relevant approach to so-called global environmental crisis. There are no environmental fixes within the dominant code, since that code overdetermines the future, thereby perpetuating ecologically untenable cultural forms. The possibility of a sustainability transition (the attempt to overcome destitution and avoid ecocatastrophe) becomes real when mediated by and through ecosemiotics. In short, reflexive awareness of humankind's linguisticality is a necessary condition for (...) transforming ecologically maladaptive cultural forms. As a multidisciplinary, interdisciplinary research program integrating the human and natural sciences, ecosemiotic inquiry closes the gap between biophysical ecology and human ecology. A provisional outline of a pragmatic theory of ecoserniotics attempts to describe the processes by which adaptive cultural changes might be facilitated and points toward substantive content areas that constitute sites for further research. Ecosemiotic inquiry frames cultural codes as these shape and reproduce the ongoing stream of individual and societal choices that shape distinctively human existence in a larger context of biophysical realities that drive natural selection. However, while ecosemiotics is a necessary condition for the sustainability transition, it is not a sufficient condition. (shrink)

Dans cet article, j’essaie de montrer que le dépassement et le rejet du dogmatisme sont un aspect décisif du changement dans la pensée de Wittgenstein qui a eu lieu au début des années 30, quand il commence à mettre en valeur l’autonomie de la grammaire du langage et à parler d’images grammaticales et de jeux de langage en tant qu’objets de comparaison. En examinant certains traits fondamentaux de ce changement, je mettrai en évidence l’impulsion et les idées décisives que Wittgenstein (...) a reçues des nouveaux développements dans les mathématiques et la science naturelle du début du 20e siècle.It will be argued that the overcoming and avoiding of dogmatism is a decisive feature of the change in Wittgenstein’s thinking that takes place in the beginning of the 1930’s when he starts to emphasise the autonomy of the grammar of language and to talk about grammatical pictures and language games as objects of comparison. By examining certain crucial features in this change in Wittgenstein’s thinking, it will be shown that he received decisive impulses and ideas from new developments in mathematics and natural science in the early 20th century. It is compelling, candid and revealing about the beginning and the goal, and everything in between: early work as a journalist on The Toronto Star, travels (...) with Elvis Presley, arrival in Britain, loves and friendships, academic rivalries and battles, marriages and affairs, self-interest and empathy. It sets out resolutely to explain how and why it all happened. It is as much a narrative of Ted Honderich's philosophy. He makes hard problems real. Philosophy from consciousness and determinism to political violence and democracy comes into sharp focus. Along the way, questions keep coming up. Does the free marriage owe anything to the analytic philosophy? What are the costs of truth? Are the politics of England slowly making it an ever-better place? This review summarises why it is difficult for Darwinian evolutionary theory to explain the existence and function of consciousness. It then evaluates whether Humphrey's book Soul Dust overcomes these problems. According to Humphrey, consciousness is an illusion constructed by the brain to enhance reproductive fitness by motivating creatures that have it to stay alive. Although the review entirely accepts that consciousness gives a first-person meaning to existence, it concludes that Humphrey does not give a convincing account of how this can (...) arise from random variations in the genome. Nor does he demonstrate how first-person experiences might enter into or be reducable to third-person functioning. The review concludes that Humphrey's case is unconvincing, and goes on to suggest that an entirely different, non-reductive approach may be required to understand consciousness. (shrink)

In his recent book The Foundation of Bioethics , H. Tristam Engelhardt Jr. advances the idea of a peaceable pluralist moral society based on principles of autonomy, beneficience, and ownership. This paper tries to show that unless there is one and only one rationally sustainable definition of "a person", then the peaceable society cannot remain peaceable, but will be stirred up by groups with different and equally rational definitions. The paper further tries to show that Engelhardt's own definition of "a (...) persons in the strict sense" is an unsatisfactory solution to the problem, and the same is true for any of the possible compromises.
